Terms of Service

Performance of Services

1. CKG Productions agrees to take photographs and/or video footage as per the client’s stated request, allowing for artistic expression.
2. CKG Productions agrees to capture as well as edit all material in high resolution for further use by the client.
3. The client agrees to CKG Productions’ editing style and artistic approach.
4. CKG Productions cannot be held responsible for late arrivals on the client’s behalf; late arrivals will result in the client forfeiting the time missed and having to shoot within the allocated time remaining for the shoot.
5. Turnaround time is estimated at 6–12 weeks.
6. PHOTOS or BOTH PHOTOS AND VIDEO: 6–12 weeks from date of photo selection by the client.
7. VIDEO ONLY: 6–12 weeks from date of song choice by the client.
8. Turnaround may be longer depending on workload.
9. The client will be kept informed regarding progress of images and/or videos. Times quoted are estimates only and are not binding.
10. Once images and/or videos are completed, they will be uploaded to Google Drive, and the client will receive a link with access to download files within 2 weeks.
11. The client is responsible for downloading and securely storing files; CKG Productions cannot guarantee availability after 14 days.

Client Responsibilities & Selections

1. The client agrees to the quantity of images and/or videos as per the quotation/invoice. Any additional work will be added to the final invoice.
2. The client agrees to the shoot duration stipulated; any extra shoot time will be added to the final invoice.
3. CKG Productions allows one free basic rework on any final video, communicated within 48 hours of receiving the Google Drive link. Advanced editing will be charged additionally.
4. CKG Productions will not under any circumstances send unedited footage or images.
5. A PDF will be sent to the client to select images for editing. The client may not screenshot or use images from this PDF.
6. Images will be delivered in colour and greyscale and sneak peek images (approx. 6) will be sent within 1–2 weeks after image selection.

Travel Expenses and Accommodation

1. CKG Productions charges standard AA rates for travel.
2. The client is responsible for all travel and accommodation costs, including flights, car hire, internet, meals or other related expenses.

Revisions / Advanced Editing

1. A basic rework includes minor adjustments such as trimming, clip order changes, or minor colour/sound edits.
2. Structural or content-based revisions (adding/removing clips, new music, extensive edits) will be billed at an hourly rate.

Liability and Force Majeure

1. CKG Productions is not liable for any loss, damage, or injury related to the services.
2. In the unlikely event of data loss, camera malfunction or unforeseen issues beyond CKG Productions’ control, liability is limited to a refund of payments received.
3. Neither party is liable for delays or cancellations caused by force majeure (illness, accidents, natural disasters, power outages, load shedding, government restrictions). Reasonable efforts will be made to reschedule.

Client Conduct

1. The client agrees to ensure that all participants are punctual and cooperative during the session.
2. CKG Productions is not responsible for compromised coverage due to lateness, uncooperative behaviour or venue restrictions.

Invoices, Quotations & Payment Terms

1. The client agrees to the total amount due and retainer fee as stipulated on the invoice. Additional costs may be added for extra time, images/videos or advanced editing.
2. A non-refundable 50% retainer fee is required to secure the booking and must reflect in CKG Productions’ bank account no later than 24 hours prior to the shoot date.
3. All quotations and invoices are valid for 30 days; after this, prices may change.
4. The final balance must be paid within 7 days of the shoot or before delivery of final files, whichever occurs first, including any additional costs incurred during the shoot.
5. Clients are responsible for all additional costs such as venue hire, accommodation, flights and car hire.
6. In the event of non-payment, the client is responsible for all reasonable collection and legal costs incurred by CKG Productions.

Postponement & Cancellation Policy

1. All booking fees are non-refundable for permanent cancellations.
2. Retainers may be applied to a later shoot date within 6 months of the original date.
3. A minimum of 7 days’ notice must be given to cancel or reschedule.
4. CKG Productions reserves the right to cancel bookings if the retainer and signed contract are not received by the deadline.
5. In the event CKG Productions must cancel due to unforeseen circumstances (e.g., illness, emergency, equipment failure), the client will be offered a reschedule or full refund.

Copyright

1. CKG Productions retains full copyright and ownership of all images and videos produced.
2. Clients receive a personal, non-exclusive license to use final edited content for personal, promotional or portfolio purposes.
3. Commercial use (advertising, resale, publication, promotion) requires a separate written agreement.
4. Clients must credit CKG Productions when sharing images or videos on social media or publicly.
5. Clients may not alter, edit, filter or rework images or videos without prior written consent. Legal action may be taken for infringement.
6. Clients may request, within reason, in writing that their material not be used for marketing or promotional purposes by CKG Productions.
7. Clients agree to share these terms with any third party who requests use of the images or videos.

Dispute Resolution & Governing Law

1. Any disputes arising from this agreement shall be governed by the laws of the Republic of South Africa.
2. Both parties agree to attempt mediation before pursuing legal action.
